Go Eve Terms and Conditions

 

Eligibility of Membership

Membership of Go Eve, and insurance cover provided, shall only be available to people who meet the following acceptance rules:

  • Are over the age of 23

  • Holders of a full valid UK driving license

  • Have held their full licence for a minimum of 3 years

  • Been resident in the UK for 2 years

  • License holder must have a permanent address or residence where their license is registered

  • Have no more than 6 penalty points in the last five years

  • Have had no more than one at-fault claim in the last three years

  • Have had no more than two theft claims in the last three years

  • Have not been disqualified from driving for any period during the last five years and not exceeding three months in the last ten years.

  • Have not been convicted of, or have a pending prosecution for any criminal offence in the last 10 years

  • Have no pending prosecution pending for any offense, or combination of offenses, that may result in more than 6 penalty points on the driver’s driving licence, or may result in, a loss of licence or suspension or ban from driving.

  • Members must not use the vehicle for any commercial gain, business or occupation outside of travel to and from a place of permanent employment, occasional other journeys to employment meetings that are not intended for direct personal gain or use for social, domestic or pleasure.

  • Must not have suffered from any disability or medical condition which has not been notified to the DVLA or which has been notified and resulted in the refusal of a driving licence.

 

Acceptance

Satisfying the eligibility criteria does not automatically give an applicant the right to become a member of Go Eve:

  1. Acceptance of the Driver’s application is subject to approval by Go Eve at its sole discretion.

  2. An application may be denied based upon additional criteria established from time to time by Go Eve and its insurance providers.

  3. A Driver may, at Go Eve’s sole discretion, be restricted from driving certain vehicles based upon the Driver’s history and experience.

  4. Go Eve reserves the right to terminate membership without notice for any breach under the qualification criteria and/or any other term.

  5. The Driver must accurately, truthfully, and fully complete the application process and deliver all information and documents required under the application process.

  6. The Driver must accurately, truthfully, and fully inform Go Eve of any changes to the criteria listed above or of any other reason that might affect qualification at any time after the start of services.

 

Availability and reservations

  1. Meeting the qualification criteria and successfully completing membership registration will allow access to the Go Eve app or other online platform to access Go Eve’s vehicles and services, but the provision of a car, and the use of the vehicle, are strictly subject to availability.

  2. Once approved drivers may reserve a car by placing an order via Go Eve’s reservation system.

  3. For drivers invited to share a vehicle the approval process is unchanged. Once approved, drivers are granted access to the invitee’s car booking calendar. A new member can then make a reservation to access the shared car immediately following approval. The earliest booking must take place at least 8 hours later than the point of approval.

  4. Reservations will be made on an as-available, first-come, first-served basis, and Go Eve does not guarantee the availability of the services.

  5. The length of each term of use of the services will be agreed to on a per drive basis via Go Eve’s reservation system.

  6. Go Eve reserves the right to change or cancel Services at any time with or without notice.

  7. Go Eve reserves the right to change the vehicle provided to fulfill, but not limited to, vehicle servicing requirements.

  8. The Driver will use a smartphone (or during an individual booking, the car key) to lock and unlock Go Eve vehicles.

  9. The minimum subscription period is 1 month, 30 or 31 days.

  10. The cancellation period to return a vehicle and cancel the contract is one month from the point that notice is given.

  11. No more than 1 car can be ordered and the subscription canceled prior to vehicle delivery.

  12. Pre-delivery hold period cancellations beyond twenty-four (24) hours of ordering will be charged for the minimum subscription period as described above.

  13. Use of a Go Eve vehicle is ended when the hire agreement expires and has been collected or returned to the agreed location at the agreed date and time with Go Eve. If a charger is on site, the vehicle must be put on charge. The vehicle must be locked, clean (for inspection), and properly parked when being returned.

  14. If a Driver has parked the Go Eve vehicle in a Designated Parking Zone and is not able to lock and/or charge the vehicle (where a charger is available), the Driver should immediately call the Go Eve team.

  15. Our Premium vehicles will be labeled accordingly on the Go Eve website. To drive these vehicles, you must be between 30 and 85 years old.

 

Usage and sharing

  1. Absolutely no smoking is allowed in Go Eve cars. If a vehicle is returned and smoke is detected then Go Eve will charge the driver the full cost of rectification (up to £500).

  2. Pets are allowed in our cars subject to the vehicle being deep cleaned by the driver before it being returned to Go Eve. If a vehicle is being shared then the primary driver must inform their users, and set the rules for the group, whether pets are allowed or not.

  3. At the start of every booking, drivers must check the vehicle for damage.  Members must leave the vehicle in a good condition so it is important to report any issues at the beginning of a reservation so Go Eve can hold the right member accountable for damage. If there’s something wrong it must be reported via the Go Eve app.

  4. If cars are being shared they should be kept clean and tidy inside and out at all times. If an individual leaves personal belongings in the car they do so at their own risk and should notify the wider group to check this is acceptable (e.g. a child seat could stay in the car if other users do not need it to be removed for their booking).

  5. Cars must be returned on time from a booking or the user could be liable for a charge of £35.

  6. Cars should be returned with enough charge for the follow-on booking in the group. If this causes a complaint for the follow-on user this could lead to a penalty charge of £35.

  7. Keys and fuel cards must be returned and stored in the dock in the car at the end of each booking.

 

Agreement of the terms of conditions

  1. If the Driver does not meet the Go Eve membership eligibility criteria or does not agree to the Terms and Conditions then the Driver may not, under any circumstances, access or use any of Go Eve’s vehicles or Services.

  2. By successfully completing the registration process, using or taking delivery of a Go Eve vehicle or by accepting Go Eve services; the Driver warrants that the Driver Criteria and terms and conditions are accepted without change or reservation.

  3. Conditions of use will strictly adhere to all exclusions, provisions, and terms listed in this Agreement.

Amendments to the agreement

  1. Go Eve reserves the right to change the terms of this Agreement from time to time.

  2. Go Eve will give notice of Agreement changes to Drivers in a timely manner.

  3. Go Eve change of terms notices will be considered given when such notice is:

    1. Indicated and accessible from the first page from Driver log-on to the Go Eve website

    2. Indicated and accessible when the Driver uses the Go Eve app.

    3. Provided by email to the Driver’s email address.

    4. The Driver may terminate membership with Go Eve within ten (10) days of a change of terms notice.

    5. A change of terms notice will be deemed to have been accepted by the driver after ten (10) days of delivery.

 

Insurance

  1. Any Driver authorised to operate a Go Eve vehicle under this Agreement will be covered by Go Eve’s vehicle liability insurance which provides coverage for 3rd party cover for accidental death of or injury to any person relating to an accident.

  2. Significant Exclusions and Limitations to provision of insurance by Go Eve include but are not limited to the following:

    1. Loss or damage to the Go Eve vehicle arising from theft or attempted theft whilst the ignition key has been left in or on the vehicle.

    2. Any excess agreed at point of subscription for some vehicle types and drivers under twenty-five (25) years of age may have an additional excess levied.

    3. Accidental death of or injury to any person when the third party is liable.

    4. The cover provided for damage to property is limited to £10,000,000 in respect of any one occurrence or series of occurrences arising out of one event. This limit is increased to £20,000,000 for any incident involving a private motor car. The limit is restricted to an amount of £5,000,000 if at the time of the loss, damage or legal liability occurring the Insured vehicle(s) was/were being used for the carriage of passengers for subscription and reward or the carriage of Hazardous goods.

    5. Go Eve has no liability for any loss of, or damage to, any goods in or on the vehicle or in or on any third-party vehicle.

    6. Go Eve has no liability for any loss, damage, injury or death in relation to any Driver due to any claims made by a third-party for any loss or damage arising from or in relation to the reservation, non-availability, supply, operation or use of extra equipment which includes but is not limited to; luggage racks, bicycle racks, baby seats, whether supplied by Go Eve or by the Driver.

    7. The Driver is responsible for the safe installation of vehicle accessories and must check the condition before each use.

    8. Go Eve is not responsible for any loss or damage to any personal property in or around any vehicle or Go Eve’s premises.

    9. Should the Driver commit any breach under the terms of this agreement then the Driver will be liable to settle directly all costs for any damage, insurance claim, litigation, third party claim for direct, punitive or consequential losses.

    10. The use of a Go Eve vehicle is prohibited rail side and air side. We will have no legal liability of whatsoever nature directly or indirectly caused by or contributed to by, or arising from the vehicle whilst in or on that part of any aerodrome, airfield, airport or military installation provided for:

      1. the take-off or landing of aircraft and aerial devices or for the movement of aircraft and aerial devices on the ground

      2. aircraft parking including any associated service roads, refuelling areas, ground equipment parking areas, aprons, maintenance areas and hangars.

    11. In no event will Go Eve be liable to a Driver or any third party for any indirect or incidental costs, punitive damages or any consequential losses including but not limited to the loss of profit.

More…

  1. A Driver must not allow any other person to drive their Go Eve vehicle or to access their Go Eve app. Other drivers that wish to use the vehicle must be invited by a member, have their membership confirmed, and make their own booking. Members can share a booking with other drivers in their group but this must be approved, activated, and agreed to in the app. If any dispute arises in a joint-booking Go Eve will assume the car was being driven by the driver who last unlocked and enabled the car with their app.

  2. Any unauthorised use of the Go Eve app and/or a Go Eve vehicle must be immediately reported to Go Eve by calling 0208 798 2450.

  3. Failure to comply with this clause may result in you, regardless of the other person using the vehicle, the App or services, being subject to:

    1. Termination of membership without notice.

    2. Invalidation of insurance coverage.

    3. Liability for any losses, liabilities and damages.

    4. Liability for the applicable fees and costs for Go Eve vehicle use.

    5. Liability for any death, injury or damage to property as a result of a breach of this clause.

  4. Go Eve reserve the right to maintain and protect vehicles and to prevent and detect crime by using electronic devices to monitor the condition, performance and operation of Go Eve vehicles and/or to track the movement of Go Eve vehicles.

  5. Information gathered by electronic devices may be used both during your membership and after expiry and/or termination of your membership.

  1. On becoming a Go Eve driver, the Driver represents and warrants to Go Eve that the Driver has received all explanations as the Driver may have reasonably requested concerning the content of these terms and conditions, including all schedules.

  2. The rights granted to the Driver under this Agreement are not assignable or transferable in whole or in part.

  3. Any attempt to transfer this Agreement without the written consent of Go Eve shall be void and of no force or effect.

  4. Go Eve may assign these terms and conditions to an affiliate or to another entity.

  5. No delay or omission by Go Eve to exercise any right or power occurring upon any non-compliance or default by the Driver shall impair such right.

  6. All terms and conditions are governed by and constructed in accordance with English and Welsh Law.

 

Payment and Fees

  1. The Driver promises to pay Go Eve all fees associated with the hiring of the car, driving charges (including but not limited to any stated mileage overage and/or toll fees), driving licence verification, and any associated application and/or membership fees.

  2. All application and subscription fees are non-refundable.

  3. Any toll charges incurred whilst driving are the responsibility of the Driver in all cases, however, the vehicle will be registered for the London Congestion Charge by Go Eve.

  4. Mileage included in the subscription fee is 1,000 miles per month. This allowance can be carried proportionately over the timeframe of the agreement as long as it is applied to the same vehicle.  Additional mileage can be purchased in advance through mileage packages or charges will apply for excess mileage on a monthly basis. Mileage packages can not be purchased retrospectively and only one package can be purchased per month. Mileage will be measured on a monthly basis and will not roll over from month to month.  The current prices for optional mileage packages and excess charges are:

5. It is strictly outside the terms of this agreement for a driver to exceed 1,000 miles per month unless customers have purchased additional mileage packages.

6. Go Eve reserves the right to terminate this Agreement and recover the vehicle should Go Eve record or anticipate, at their sole discretion, usage in exceeding 1750 miles per month including additional mileage packages.

7. If a coupon is redeemed and membership is cancelled within 30 days, the coupon may become void and all driving will be charged to the Driver.

8. Drivers are responsible for the payment of all fines incurred through speeding, parking or other driving offences whilst using a Go Eve vehicle.

9. Drivers may settle payments due via credit card, debit card, or other means as accepted by Go Eve.

10. Drivers are responsible for keeping the car charged and failure to do this, which requires a recovery of the vehicle due to the Driver, will be subject to a fee of £50 plus the costs of recovery (invoices will be shared with the Driver).

11. Any Driver account which is past the due date for any payment will be suspended.

12. Go Eve reserve the right to terminate or suspend membership if payment of any amount due is rejected by the credit or debit card provided by the Driver. If your subscription is terminated, your vehicle will be recovered with immediate effect.

13. Drivers are responsible for providing and maintaining current credit card, debit card or direct debit information on file with Go Eve.

14. Ongoing issues with credit card, debit card or direct debit billings may result in termination of membership.

15.  Under no circumstances will Go Eve be responsible for any overdraft or other fees charged by a Driver’s credit or debit card company or bank.

16. Go Eve also reserve the right to change the payment due date and/or terminate any Driver’s account that has been in arrears or late for payment.

17. Should the customer request a new subsequent hire agreement, payments are authorised 7 days in advance of the new hire agreement start date. If this transaction is not successful at least 3 days before your new subscription start date, your new hire agreement will not be confirmed.

18. Go Eve may engage third parties to collect amounts owed to Go Eve by a Driver.

19. The Driver will be responsible for any collection or litigation fees related to overdue charges.

20. Go Eve also reserves the right to charge interest on overdue charges at the applicable legal interest rate plus 4% over standard UK base rate.

21. Payments received from members who are not primary car drivers will be reconciled and passed back to the main subscriber within 5 days.

 

Data and Information

  1. All personal data is collected, stored and deleted strictly in line with GDPR May 2018 regulations. Where any services or benefits referred to above are provided to the company by third parties, the company may disclose some of your personal information to those third parties strictly in line with GDPR May 2018 regulations.

  2. All personal data is collected, stored and deleted strictly in line with GDPR May 2018 regulations as stated under the Go Eve Privacy and Cookie Policy which is available via the Go Eve website www.GoEve.co.uk

  3. Go Eve may use any information that a Driver has provided, including any personal information, for the purposes of processing and collecting payment under this Agreement, monitoring fraud and dealing with any issues before, during and after membership.

  4. All Drivers are responsible for providing and maintaining current email, mobile phone, mailing address and other account information.

  5. All communications with Go Eve including email, telephone and social media may be monitored and recorded by Go Eve and the use of listed communication channels represents the Driver’s consent to be monitored or recorded.

  6. The Driver agrees to maintain accurate, complete and up-to-date account information.

  7. Failure to provide accurate information may result in the Driver’s suspension or termination from using Go Eve’s services.

  8. Drivers must carry a valid driver’s licence card at all times when in charge of a vehicle.

  9. In order to maintain and Go Eve’s vehicles and to prevent and detect crime we use electronic devices to monitor the condition, performance and operation of our vehicles and/or to track the movement of vehicles. This information may be used both during your membership and after the expiry and/or termination of your membership.

  10. Because driving for Go Eve requires maintaining a good driving record Go Eve may from time to time check Drivers records and reserves the right to suspend the relationship with any Driver who does not meet Go Eve’s eligibility requirements.

  11. Go Eve may obtain information from third parties concerning applicants and Drivers to help establish eligibility for membership.

  12. Go Eve will carry out checks such as, but not limited to, an identity check.

  13. As part of the registration process and spot checks Go Eve will pass your personal information to third party agencies for the purposes of carrying out identity and soft credit checks (this is not a credit check) and they may keep a record of any search.

  14. Driver information is not sold to third parties.

  15. By submitting to Go Eve usernames, passwords and other log-in credentials (collectively, “Credential Information”) for any third party sharing economy service (collectively, “Providers”), you hereby grant to Go Eve a non-exclusive, royalty-free, fully-paid license to use that Credential Information.

  16. Go Eve may use and store the data and information made available by the Providers to you through the use of your Account Credential Information related to your usage of, and interactions and transactions with, third party sharing economy service platforms (your “Provider Account Information”) in accordance with this Agreement.

  17. The Driver warrants and represents to be entitled to submit Credential Information to Go Eve without any obligation by Go Eve to pay any fees or be subject to any restrictions or limitations.

  18. By using the Service, you expressly authorise Go Eve to access your Provider Account Information, on your behalf as your agent.

  19. The Driver warrants that the Service is not sponsored or endorsed by any third-party Providers.

  20. Subject to all applicable laws; Go Eve may provide a third party with information (including your personal data and any data of Go Eve) about you, provided during your application, for the use of a vehicle or the Services if:

    1. There is a complaint, dispute or conflict, including an accident, relating to a Driver;

    2. It is necessary to enforce the terms of any agreement between you and Go Eve;

    3. It is required, in Go Eve’s sole discretion, by applicable law, regulation, ordinance, license, or operating agreement;

    4. It is necessary, in Go Eve’s sole discretion, to protect the safety, rights, property, or security of Go Eve, the Services, or any third party;

    5. To detect, prevent or otherwise address fraud, security or technical issues;

    6. To prevent or stop activity which Go Eve, in its sole discretion, considers to be, or to pose a risk of being, illegal, unethical, or legally actionable

 

Collisions

  1. A Driver is responsible for all and any damage that occurs to a Go Eve vehicle whilst in his or her possession (including the entire time the vehicle is reserved under the Driver’s account).

  2. The Driver is responsible for the full value of any damages or injuries caused to third parties or their property.

  3. Such damages include, without limitation, the repair costs (estimated or actual) for the Go Eve vehicle and third-party property, injuries to third parties, costs associated with the recovery or transportation of Go Eve vehicles, and the loss of use of Go Eve vehicles or third-party property

  4. Go Eve provides insurance as part of the subscription conditions and covers most damages arising from a Drivers use of a Go Eve vehicle, and the Driver’s liability for damages will generally be limited to the damage excess charge.

  5. Any breach of the terms and conditions may invalidate the insurance cover Go Eve provides.

  6. The Driver responsible for the full cost of any accident or incident and any damages incurred of insurance is invalidated due to any breach of the terms and conditions by the Driver.

  7. If the Driver is involved in an incident whilst in charge of a Go Eve vehicle; a damage excess charge (of up to £1,000) may apply.

  8. A damage fee may apply, but is not limited to, dents, scratches, collisions, flat tires, windshield cracks, dead batteries, engine problems, vandalism, theft, lost or damaged keys or other Go Eve property, third party damages, and, in some cases, third party personal injuries.

  9. Tyre damage: Go Eve will replace the vehicle tyre ‘free of charge’ if the tyre tread has come to or is near the UK legal limit, where the tyre has been worn within the manufacturer’s timeline, and not from excessive acceleration or braking. Tyre puncture repairs are not included and if a tyre technician deems a tyre unfit for use or unrepairable the tyre will have to be replaced and will be charged. Go Eve cannot confirm on every occasion the cost of a replacement tyre or tyre puncture repair as this is variable and could depend on call-out fee’s and other factors outside of our control. The cost will be confirmed after the work has been complete and will be communicated via email. We have a strict safety policy so we do not permit the replacement or repair of any tyres with unknown suppliers outside our supplier network.

  10. In the event of a collision or other incident where additional investigation is required, Go Eve will charge the payment card for £1,000 at the start of the investigation process. At that time, the Driver’s account may be temporarily disabled pending investigation.

  11. The Driver may be reinstated, at Go Eve’s sole discretion, upon completion of an investigation.

  12. If the cost of the repair is less than £1,000, the Driver will be refunded any remaining balance from the damage excess fee.

  13. A Driver found to not be at fault will receive a full refund.

  14. A Driver will be responsible for the payment of £1,000 (being a Damage Excess), which will be automatically deducted for the allocated credit card.

  15. Each Damage Excess will be returned upon conclusion of a blame free, without penalty insurance settlement.

  16. The insurance policy satisfies the requirements of the relevant law applicable in Great Britain and Northern Ireland to insure against liabilities for death, bodily injury and property damage caused by, or arising out of, the use of a vehicle on the road in Great Britain and Northern Ireland only.

  17. The elimination or reduction of liability for the Damage Excess charge will not apply should the Driver:

    1. Use the vehicle in violation of this Agreement, including if the Driver permits any other person to drive a Go Eve vehicle, engage in any prohibited use of a Go Eve vehicle or, purposely or through negligence, damage a Go Eve vehicle or third-party property;

    2. Have membership suspended or terminated by Go Eve;

    3. Have two at-fault incidents in a Go Eve vehicle involving property damage or any third party;

    4. Display evidence of reckless driving or not paying due care and attention;

    5. Fail to close and lock all windows, doors, the bonnet and boot and the vehicle is stolen, damaged or vandalized;

    6. Fail to notify Go Eve within 24 hours after an accident or loss; or fail to pay any other amount due under this Agreement

 

Parking, Charging, and Returning Vehicles

    1. The driver must make the vehicle available for collection by Go Eve at the location stated and agreed by Go Eve.
      1. Failure to leave the Go Eve vehicle at the proscribed location will be subject to a collection fee.

      2. Upon return of the vehicle; the driver must put the key and charging cards (BP and Shell) in the glove compartment and key/ card dock of the Go Eve vehicle.

      3. Failure to leave the charging cards (BP & Shell) in the vehicle on handover will be subject to an administration fee.

      4. If the car has a parking permit that covers the vehicle up until the point of collection

 

Confidentiality

Each party shall treat in confidence the other party’s confidential information and shall not disclose it for 5 years, from the date of this agreement, save for the proper performance of this Agreement or where law requires such information or where the information is already in the public domain.

 

Obligations related to the terms of this Agreement will survive termination for the following clauses:

  3. Confidentiality

 

Survival

  1. Pricing for access to Go Eve vehicles and services includes the cost of maintenance and insurance as stated in the Go Eve website www.goeve.co.uk

  2. Go Eve reserves the right to amend rates, rate structures, terms and credits from time to time with reasonable notice.

  3. Late payment fees will be charged per occurrence and posted to the Driver’s account.

  4. All Go Eve vehicles are electric and to be connected for charging at the end of a booking term, if the vehicle is returned to a location with a charger.

  5. A driver must connect a vehicle and ensure that it says the vehicle is charging on the central dashboard.

  6. Go Eve reserves the right to charge the Driver a £35 fee for failure to ensure the car is ready at collection with a minimum charge of at least 60%

  7. A Driver failing to return the vehicle to its assigned location may be charged for the total costs of recovering the vehicle.

  8. A vehicle may be reported to the police as missing should Go Eve not be able to contact a Driver and the Driver will be liable for all associated fees.

  9. Fees and amounts:

    1. Damage fee: Up to £1000, based on cost of repair.

    2. Failure to report an accident / damage fee: £500 above the cost of repair if the driver can be proven to be aware of an accident or damage they caused, but failed to declare it within 24 hours.

    3. Late payment: £35.

    4. Returned vehicle late: £10 per thirty (30) minutes over the end of booking time, unless Go Eve are notified and permit an extension for exceptional circumstances.

    5. Go Eve reserves the right to charge the customer for any cost incurred caused by the customer, including but not limited to:

      1. Failure to properly secure the vehicle (open windows or unlocked car).

      2. Removal of any Go Eve equipment (including charging leads, phone holder, spare wheel, lifting jack, BP and Shell charge cards)

      3. Vehicle abandoned or returned to the wrong location.

      4. Failure to leave the BP and Shell cards (charger release card) as prescribed will be subject to an administration charge of £35.

    6. Vehicle collection fee (if not returned to the location as instructed by Go Eve) is charged at a minimum of £1.70 per mile from the Go Eve Head Office or £200 whichever is the greater.

    7. Parking fines issued under any circumstances, including but not limited to parking fines issued to Drivers in areas where charging points are provided, are strictly the legal responsibility of the Driver and must be settled without unreasonable delay.

    8. Failure to cooperate with an insurance claim will be subject to a fee of £3,000.

    9. Drivers will be charged for the subscription until they have successfully locked and put the Go Eve vehicle on charge if there is a charger at the return location.

    10. PCN admin charge: £10.

    11. Drivers should return the Go Eve vehicle to their agreed designated parking location at the end of the period of subscription.

  10. Drivers are liable for all charges or fines incurred by leaving a Go Eve vehicle parked illegally.

  11. Where off-street parking or private garage parking is not available the Driver must secure any necessary or relevant resident’s permit (or equivalent) to be displayed clearly inside the vehicle when parked. Go Eve will support by supplying a copy of the vehicle registration documents on request.

  12. The Driver is solely responsible for establishing the necessity for and securing the lawful use of a resident’s permit (or equivalent). At the end of the subscription, Go Eve will remove the parking permit and return it back to the member.

  13. If the vehicle is towed or clamped during the reservation, then the Driver is responsible for recovering the vehicle and paying all costs, as well as any late fees that are incurred.

 

Term and Termination

  1. This Agreement shall commence upon the acceptance by Go Eve of the signed Agreement and payment for the car and any applicable fees and/or charges.

  2. The minimum term of this Agreement is 1 calendar month.

  3. The term of this Agreement shall expire on the end date of the hire agreement.

  4. The Driver shall remain responsible for any fees, costs or expenses incurred prior to termination of this Agreement.

  5. Go Eve, upon notice to the Driver, may also terminate this Agreement should the Driver fail to pay any sums due under the terms of this Agreement.

  6. Go Eve, upon notice to the Driver, may also terminate this Agreement should the Driver fail to comply with any term or condition specified in this Agreement.

  7. Go Eve, upon notice to the Driver, may also terminate this Agreement should the Driver engage in any activity or conduct that Go Eve deems inappropriate, negligent, offensive, abusive or otherwise unacceptable.

  8. Upon termination of the Agreement the rights to use all services and vehicles shall immediately terminate.

  9. Upon termination of the Agreement the Driver agrees to immediately return to Go Eve any vehicle or any other property of Go Eve.

  10. The Driver shall be responsible for and agrees to pay any legal fees, court costs or expenses associated with enforcing the terms of this Agreement whether upon termination or otherwise (including without limitation, any costs relating to recovering any of the foregoing property or any amounts due and owing to Go Eve).

 

General Provisions

The use of a Go Eve vehicle is prohibited under the following conditions:

  1. Use of a Go Eve vehicle off-road, or for racing, pacemaking, testing the vehicle’s reliability or speed, teaching someone to drive or in connection with motor rallies, competitions or trials.

  2. Towing of any trailer or other vehicle.

  3. By any person who is under the influence of alcohol or any drug or medication under the effects of which the operation of a vehicle is prohibited or not recommended.

  4. In the carrying out of any crime or for any other illegal activity or purpose.

  5. In an imprudent, negligent, or abusive manner or any other abnormal use of the vehicle.

  6. By any person who has provided Go Eve with false information or whose representations are determined to be false including, without limitation, regarding his/her name, age, or address.

  7. Carrying more passengers than the designed seating capacity of the vehicle.

  8. Carrying baggage or other items that would cause the vehicle to be overloaded.

  9. Carrying or transporting any hazardous, toxic, flammable, dangerous or illegal materials.

  10. Driving while using a mobile communication device that may distract you from driving, including driving while texting, emailing, using a cell phone without a hands-free device or otherwise engaging in similar activities that may be prohibited by applicable law.

  11. Any unreasonable or inappropriate use of a Go Eve vehicle, as determined by Go Eve in its sole discretion.

  12. Smoking is strictly prohibited in a Go Eve vehicle.

  13. Pets unless they are transported in locked pet carriers. If you have agreed as a sharing group that pets are permitted this must be set in the app and a deep clean of the vehicle must be conducted prior to return (as though no trace of a pet being present can be found).

  14. Drivers are subject to additional charges if evidence of smoking or pets is found in Go Eve vehicles.

  15. If a Driver smokes or permits any other person to smoke in a Go Eve vehicle, the Driver’s membership may be terminated.

 

Vehicle Pick-up and Return

  1. Drivers pick up the selected vehicle in the Designated Parking area(s) as indicated on the Go Eve app.

  2. The Go Eve vehicle must be returned parked, secured, clean (rubbish removed), back on charge if a charger is available (including checking that the vehicle says it is charging on the dashboard), and in good working order, within the Designated Parking area(s).

  3. If you have not made a reservation in advance and the Go Eve app shows that there are available Go Eve vehicles, you may reserve a vehicle and take possession of a vehicle after confirming on the Go Eve app.

  4. Vehicles must be reserved via the website or the Go Eve app prior to possession.

  5. Prior to taking possession of a vehicle, you must do an exterior walk-around and an interior look-over and submit any damage through the App.

  6. Before driving the vehicle, you must notify Go Eve of any damage or abnormality encountered on the vehicle or in the operation of the vehicle.

  7. You should report the following to Go Eve:

    1. Any warning lights that stay on after the ignition is engaged.

    2. Indication of leaking fluids near the vehicle.

    3. Cracks or chips in the windscreen.

    4. Missing or inoperable signal or driving lighting.

    5. Broken or missing rear-view mirrors.

    6. Any other condition that may render the vehicle unsafe to operate.

    7. Any other damage that is not recorded in the vehicles damage log located in the vehicle (the “Damage Log”).

    8. If you observe any damage that is not reported in the Damage Log, you are required to inform Go Eve of such damage prior to driving the vehicle as set out on our website.

  8. If Go Eve is not notified of a problem prior to taking possession of a vehicle and/or driving the vehicle, you will be deemed to be responsible for any problem with the vehicle discovered or reported after your reservation, including, without limitation, damage to the vehicle, lack of cleanliness, service drive or other applicable fees, and Go Eve may suspend, or terminate membership.

  9. The key fob to the vehicle and any public charging membership cards must remain in the vehicle and/or be returned to its designated position within the vehicle.

  10. The vehicle must be locked using the vehicle key when it is not in use during your reservation.

  11. Vehicles must be returned to the vehicle’s charging station (if applicable at the location) at the end of the subscription period, and ideally at the end of each use.

  12. Where there are no chargers present the car may be returned without connection.

  13. Using the Go Eve App to lock the vehicle when it is being returned will end your reservation/booking and also the subscription period.

  14. You must advise Go Eve immediately if you fail to leave the key/fob/starting device, charging card or parking pass (if applicable) in the vehicle.

  15. You will be charged the relevant rate for the vehicle until you notify Go Eve. Go Eve reserve the right to charge a fee to replace any of the items missing from the vehicle.

  16. You are responsible for all charges and costs incurred related to the Go Eve vehicle for the entire period of the reservation and until you notify Go Eve of the end of use.

 

Stolen Vehicles and Lost Property

  1. Stolen vehicles must be immediately reported to Go Eve by phone.

  2. You must check that you have not left any belongings in the Go Eve vehicle.

  3. Go Eve makes a reasonable effort to reunite lost belongings with their owner.

  4. Go Eve shall not be liable for any belongings left in or stolen from a vehicle.

  5. Any items found in a vehicle by Go Eve will be logged and held by Go Eve for a period of no less than a month.

  6. Belongings not claimed within this period will be passed on to charity or disposed of at the discretion of Go Eve.

  7. Go Eve properly maintains vehicles.

  8. Drivers must monitor the performance of the vehicle and will, if service or maintenance is reasonably required, inform Go Eve using 0208 798 2450.

 

Roadside Assistance

  1. Go Eve provides Roadside Assistance support as part of our service except for driving out of permissible range, allowing a vehicle to run out of fuel or charge or any breach of terms.

  2. Unusual noises or driving feel or any other problems, including but not limited to; warning lamps, indicators, inappropriate or strange engine or other mechanical sounds, performance changes or unusual driving feel, must be reported to Go Eve as soon as noted by calling 0208 798 2450. Failure to report such irregularities during the use of a Go Eve vehicle may result in the Driver’s immediate suspension or termination of membership as well as the Driver being responsible for any damages resulting from the continued use of the vehicle despite such irregularities. Such damages are not limited to the damage excess charge and are not covered by Go Eve’s insurance.

  3. All breakdowns, accidents or similar incidents involving Go Eve vehicles must be reported to Go Eve immediately by phone to 0208 798 2450.

  4. Go Eve offers 24-hour emergency assistance for situations requiring immediate attention.

  5. Please call the emergency line in the following situations:

    1. You show up for your registration and the vehicle is not there.

    2. Your key doesn’t work or your vehicle won’t start.

    3. You are unable to park the vehicle in the correct location.

    4. You are running late and unable to extend your reservation.

    5. The vehicle is displaying a warning light or has a mechanical issue.

    6. You need roadside assistance, such as a flat tire or a dead battery.

  6. Breakdown and Roadside Assistance. When using a vehicle, you must follow the owner’s manual’s instructions. If a problem arises that prevents or limits the use of the vehicle or that may compromise safety, you must immediately notify Go Eve and follow Go Eve’s instructions. Failure to acknowledge warning lights or noises from the vehicle may result in fees for negligence. 24-hour emergency roadside assistance is available for emergencies with Go Eve vehicles. Please notify Go Eve staff of any emergencies using the emergency phone number 0208 798 2450.

  7. Drivers may pay for towing, repairs, and other expenses, if authorised by a Go Eve Representative (in which case these amounts will be considered Eligible Expenses reimbursable or if approved by a Go Eve Representative you may charge them to Go Eve’s account with the applicable service vendor.

 

Accident and Collision

  1. In case of an accident, the Driver must complete Go Eve’s incident report form and obtain the following information:

    1. Date, time, and place of accident;

    2. The number plates of any other vehicles involved, their make and year, their identification number (serial number), and the insurance certificate’s number (with name, address and phone number of the insurance agent);

    3. The names, addresses, and driver’s licence numbers of the persons involved in the accident;

    4. The name, address, and driver’s licence number of the owner of the car (if he or she is not the driver);

    5. The names, addresses, and phone numbers of witnesses, passengers, and any other involved persons;

    6. Circumstances of the accident.

  2. Depending upon the severity of the accident, the Driver may also be required to fill out and obtain an official police report form, and, if possible, provide a jointly agreed-upon statement.

  3. Drivers must provide to Go Eve and any other claims adjustment service the findings of any report or any notice relating to a claim or a lawsuit against Go Eve regarding any accident involving a Go Eve vehicle.

  4. Drivers agree to cooperate fully with Go Eve in the investigation and defence of any such claim or lawsuit.

  5. A Driver’s account will be suspended until the investigation has been concluded.

 

This Agreement, made subject to the arbitration of the laws and courts of England and Wales is binding and failure to meet its terms will allow Go Eve to take certain recourse which has been identified above. By signing this agreement, all parties agree to the terms described above. Alterations to this agreement can only be made by Go Eve and must be placed in writing. Both parties will receive both versions of this agreement by email.
